David W. Clough, Ph.D., is a partner in Morgan Lewis's Litigation and Intellectual Property Practices. Dr. Clough counsels biotechnology and pharmaceutical companies on the acquisition and enforcement of intellectual property rights worldwide and the design and implementation of global intellectual property strategies. He has represented clients before various courts and administrative agencies, as well as in private mediation and arbitration. Dr. Clough has also acted on behalf of clients in a variety of reexamination proceedings and European oppositions.
Dr. Clough has litigated cases involving DNA fingerprinting probes, genetic engineering of antibodies, diagnostic DNA probes, recombinant proteins, trade secret violations, Lanham Act violations, inventorship disputes, and license disputes. He has also conducted due diligence analysis on behalf of clients in support of multibillion-dollar acquisitions.
Dr. Clough has experience with a variety of technologies and has prosecuted applications and rendered opinions in the areas of gene therapy, genetic engineering of viruses, oncolytic viruses, cloning and expression of novel proteins, nucleic acid diagnostics, nucleic acid sequencing, transgenic animals, immunotherapy, reproductive technologies, genetic engineering of antibodies, screening methods for identification of drug candidates, novel drug formulations and delivery systems, cancer therapies including oncolytic viruses and hormone therapies, treatment of gynecologic disorders, food chemistry, steroid chemistry, genetically engineered plants, methods and compositions for treating neurological diseases, and medical devices.
Prior to joining Morgan Lewis, Dr. Clough was a partner in the intellectual property practice of an international law firm where he was managing partner of its Chicago office.
Prior to attending law school, Dr. Clough served on the faculties of the University of Illinois at Chicago College of Medicine and the Northwestern University Medical School and was a postdoctoral fellow in the Department of Microbiology and Molecular Genetics and the Department of Pediatrics at Harvard Medical School. He is also an author of several scientific publications covering a number of scientific disciplines. Dr. Clough has been named to the Illinois Leading Lawyer Network by his peers and is a frequent speaker at various business, scientific, and legal programs.
Dr. Clough is admitted to practice in Illinois only and before the U.S. Court of Appeals for the Federal Circuit, the U.S. District Court for the Northern District of Illinois, and the U.S. Patent and Trademark Office.
