Evaluating Fiduciary Risks: A Look at ERISA Regulatory Enforcement and Litigation Trends
This session will provide a high level look at the latest decisions and legal theories pursued by plaintiffs’ class action lawyers regarding 401(k) fee litigation, employer-stock investments within DC plans, and challenges to the performance, expenses and risks associated with stable value investment options, as well as currently regulatory developments in these areas. The presentation also will discuss what plaintiffs’ lawyers and regulators may be looking for in their next lawsuit or investigation and ways to minimize litigation and enforcement risks going forward.
