The audio of a recent Labor and Employment Practice webcast is available for download. This session on the implications of the $105 million Starbucks verdict was presented by Morgan Lewis attorneys Corrie Fischel Conway, Michael J. Ossip, and Barbara J. Miller.

A recent decision by a California court to award more than $100 million to a class of former Starbucks "baristas" and subsequent lawsuits challenging the polling practices utilized by Starbucks and other employers have called into question traditional practices in industries in which employees typically receive and pool tips. These cases raise a number of issues for employers in the restaurant, hospitality, and other industries in which employees typically receive tips as part of their compensation. In response to these developments, Morgan Lewis offered a one-hour webcast on wage and hour issues affecting tipped employees.

Topics discussed included:

  • The facts of the Starbucks cases and the nature of other challenges to employers' practices
  • How to ensure compliance with the FLSA and applicable state wage and hour laws
  • Future trends in pooling litigation
