San Francisco - July 18, 2005 - Morgan, Lewis & Bockius LLP partner Dan Johnson obtained a significant trial victory today for client O2 Micro in a trade secrets jury trial where O2 Micro sued defendant MPS and MPS countersued for alleged patent infringement.  Mr. Johnson won $12 million in damages for unjust enrichment.  The jury also found that MPS’ conduct was willful, allowing O2 Micro to now seek enhanced damages and attorneys fees.

The case involved the theft of 11 trade secrets, (involving controller chips used in laptop computers, PDAs and LCD panels), by MPS over a four-year period beginning in September 2000.  The thefts included stealing demonstration boards that had been marked confidential, stealing confidential data sheets, and stealing confidential pricing information. 

MPS countersued O2 Micro for patent infringement on two patents, however the jury found that O2 Micro had not infringed any of the claims, and invalidated all of the claims at issue.

"The jury found O2 Micro the clear-cut winner in all key points in this case, which is significant, since a finding of invalidation in patent cases rarely happens,” said Mr. Johnson.

Earlier this year, Johnson won a $400 million settlement on behalf of Compuware in a patent litigation suit against IBM.  “Since joining Morgan Lewis, I have found this firm to be the perfect platform to expand my ability to represent technology clients,” said Mr. Johnson.
