The Merger Task Force Meets the European Court of First Instance: Losses for the EC and Lessons for the US
Following the criticism of the European Commission by the European Court of First Instance in the Airtours case last summer, last week two further significant decisions were issued by the court in Schneider Lagrand and Tetra Laval. The court again criticized the Commission’s antitrust analysis and conclusions, and overturned both decisions.
The cases together constitute a significant blow to the Commission’s merger task force, calling into question its mode of analysis and decisions like GE/Honeywell, as well as giving new impetus to various procedural and substantive reforms. The decisions have wider US and international ramifications, including for work on international “convergence” being conducted under the auspices of the International Competition Network.
This Friday, November 1, Morgan Lewis antitrust competition partners will present a one-hour live teleseminar at 12:00 noon (EST). Brussels-based Izzet M. Sinan will discuss these just-issued decisions and their wider implications with Washington-based Robert S. Schlossberg.

Robert S. Schlossberg is a partner in the Antitrust Practice in Washington, D.C. His practice focuses on the full range of antitrust counseling, with a particular emphasis on the Hart-Scott-Rodino premerger review process and merger counseling. Mr. Schlossberg is co-editor of two books on mergers.
Izzet M. Sinan is a partner in the Antitrust Practice in Brussels. Mr. Sinan, an English barrister, focuses his practice on European Community (EC) law. Mr. Sinan represents clients before the various administrative agencies of the European Commission in obtaining antitrust clearance for mergers, joint ventures, distribution/licensing and other agreements.
