Navigating Nanotechnology’s Uncertain Waters

Please join us for a webcast that will provide a timely overview of the regulatory, scientific, legal, and insurance issues facing producers and handlers of nanomaterials.

Nanotechnology has been heralded as a “new frontier” in the development of thousands of products, including pharmaceuticals, household items, automotive parts, and sporting goods.

Materials containing nanoparticles—particles less than one ten-millionth of a meter in diameter—have made their way into the workplace, the environment, and the bodies and homes of workers and consumers. The estimated economic value of products containing nanomaterials over the next several years runs into the trillions.

Yet regulatory guidance on the use of these products is sparse, and scientific research regarding the impacts of the materials has not kept pace with their proliferation. No uniform method has been adopted to effectively detect the presence of such materials in the environment. Meanwhile numerous publications and commentators speak of the potential health risk of exposure to nanomaterials, which personal injury lawyers have taken note of.

Government agencies, facing criticism that they are not moving quickly enough on this issue, have produced a range of guidance and recommendations. Companies using or manufacturing these materials must now make decisions that may be second-guessed by regulators and shareholders—or juries.
