Preparing for the Elimination of the Default Retirement Age: Lessons Learned from the U.S.

Join Morgan Lewis for an informative seminar that will discuss steps employers can take to adjust to the new default retirement age law. We'll share lessons learned in the more than 25 years since the mandatory retirement age was eliminated in the U.S.—valuable insights for UK employers that now must be prepared to live without the Default Retirement Age.

With the elimination of the Default Retirement Age on 1 October 2011, UK employers will need to adjust their policies and procedures and implement appropriate training to minimise the risk of age discrimination claims. The elimination of the default retirement age will result in the need for employers to pay more attention to the performance evaluations of older workers and to provide more candor in discussions with senior employees about their performance, contributions, and retirement plans.

The seminar will cover the following topics:

  • Whether employers should establish specified retirement ages for certain positions
  • How to deal with underperforming older employees
  • Workforce and succession planning
  • How to minimise the risk of age discrimination claims in recruitment, promotion, leadership changes, and terminations
  • Lessons to be learned from the U.S. experience
