Like never before, employers need to be aware of their responsibilities in maintaining a harassment-free workplace.

On September 30, Governor Arnold Schwarzenegger signed a law requiring all California employers with 50 or more employees to provide two hours of sexual harassment prevention training to all managers and supervisors. The training must be repeated once every two years and new managers and supervisors must be trained within six months of assuming such responsibilities. As with most laws, many questions are raised, including:

• Who is a "covered employee?" Who is a "covered employer?"

• Who should be considered a supervisor, and what if that person resides outside of California?

• What constitutes "effective interactive training?" For example, can employers use computer-based training, or is live training required?

• Is it sufficient for the training to cover sexual harassment, or must it address broader forms of discrimination as well (e.g., gender-based discrimination)?

• What are the consequences for failing to comply?
