The presentation will focus on the following:
The steps a company takes to preserve its records at the commencement of litigation can have a profound effect on the course of that litigation, as well as on the bottom line. Moreover, with the explosive growth of the use of electronic discovery, counsel's role in the timely implementation of a properly developed record preservation plan is more important than ever.

Stephanie "Tess" Blair, Esq., Director of Morgan Lewis Resources – Legal Logistics,

will share her Record Preservation Best Practice guidelines with you and will address:

  • The current status of the law regarding when you need to establish a litigation hold;
  • Issues to consider when drafting a litigation hold for your client;
  • The proactive steps counsel should take to implement a record preservation plan and monitor compliance; and
  • The possible consequences for counsel and their clients for failure to establish or monitor a record preservation plan for the course of the litigation.
