Morgan Lewis partner Robert Jon Hendricks will present on a panel entitled "Wage and Hour Class Arbitration Issues" at the California State Bar's 2nd Annual Advanced Wage and Hour Conference.

This panel will profile a cutting-edge issue affecting the practice of every plaintiffs' and defense-side wage/hour class action litigator - how to cope with the U.S. Supreme Court's decisions in ATT Mobility v. Concepcion and Stolt-Nielsen v. AnimalFeeds. The discussion will begin with background on the rise of the arbitration issue and a summary of how courts are addressing motions to compel arbitration in California and federally. Panelists will discuss, from both plaintiffs' and defense perspectives, how post-Concepcion jurisprudence is affected by the DR Horton National Labor Relations Board decision (regarding the NLRA), the Brown v. Ralphs Grocery California Court of Appeal decision (regarding PAGA), and other recent, impactful cases. The panel will survey how arbitrators are dealing with issues seeking to permit/bar class actions, and how both plaintiffs' and defense counsel are advising their clients, in light of the uncertainties created with this evolving field.
