Most employers have faced them: problem employees who are repeatedly absent from their jobs. Whether it's regular one-day absences for a variety of excuses, or an extended absence due to illness, pregnancy, or other circumstances, the employer must know the proper way to handle the situation. In-house counsel, outside counsel for employers, and employees' advocates must all understand the laws that govern these absences. Employers' counsel must be able to advise management on the most appropriate response to a given situation, while plaintiffs' attorneys must protect their clients' rights.
During this two-hour overview, expert employment law practitioners James Kelley and Corrie Fischel Conway will help attorneys, management, and employees distinguish between those situations in which absences are grounds for discharge and those that are protected under state or federal law.
Topics to be covered include:
- The Family and Medical Leave Act (FMLA)
- Employment Provisions of the Americans with Disabilities Act (ADA) and the Americans with Disabilities Act Amendments Act (ADAAA)
- Applying FMLA and ADA in Light of a Worker's Compensation Claim
- Consolidated Omnibus Reconciliation Act (COBRA)
- The Uniformed Services Employment and Reemployment Act (USERA)
