related attorney(s):
Morgan Lewis partner Michael Ossip and of counsel Corrie Fischel Conway and Julius Turman will explain the provisions of the ADAAA and its impact upon employers. They will review the steps employers should begin to take now to prepare for the new requirements under the ADA.
The ADAAA, signed into law on September 25, 2008 by President Bush, will make sweeping changes to the Americans with Disabilities Act (ADA). This legislation, enacted with broad bipartisan support, will significantly expand the scope of the ADA's coverage. Intended to overturn a series of U.S. Supreme Court decisions that interpreted the ADA narrowly, the ADAAA will make it much more difficult for employers to prevail against ADA claims. Thus, every employer covered by the ADA must take steps now to understand the new law.
Topics for discussion during this webcast will include:
- How will "disability" now be interpreted under the ADA?
- What medical conditions and impairments will now be covered?
- What changes to the term "major life activities" have been made and what is the practical impact of such changes?
- What will be the impact of the elimination of mitigating measures as a factor in determining disability?
- What changes have been made regarding "perceived disability" and how should employers react to such changes?
