In Noel Canning, the U.S. Court of Appeals for the D.C. Circuit recently decided that last year's recess appointments to the NLRB were unconstitutional. This potentially invalidates many past and future NLRB decisions. However, Noel Canning may be appealed. The same issue remains pending before other courts, with far-reaching potential consequences for employers.
