Partner John Ferriera will be presenting "Consumer-Driven Benefits." Employers are continually challenged by attempts to reign in ever-increasing healthcare costs while not overburdening employees with cost-shifting. Some employers are considering creative compensation and benefit-plan designs. These plans combine wellness rewards and consumer-driven benefit delivery models; the intention is to reduce overall health expenditures both by making employees better, more efficient consumers of health care and by encouraging employees to make healthier lifestyle choices. He will review these designs and the legal challenges raised by them under HIPAA and the ADA; he will also discuss some creative approaches to addressing those challenges.
Partner Michael Banks will be presenting "Your Day in Court." Senior Human Resources Officers are increasingly targeted for depositions in connection with hiring programs, executive compensation schemes, reductions in force, corporate diversity, and a host of other core issues. Their testimony can be a pivotal point in any litigation, reflecting company philosophies and mandates from the senior management team and the Board of Directors. He will review a portion of a videotaped deposition as a foundation of our discussion as we explore techniques for the presentation of a positive message and damage control when the top HR people find themselves on the witness stand.
Partner David Bowman will be presenting "Corporate Diversity Programs." Although the benefits of well-structured, voluntary diversity programs far outweigh the risks, many companies fail to evaluate those risks and minimize the exposure. As a result, their initiatives are coming under attack with greater frequency. Simultaneously, the overall effectiveness of diversity programs is being called into question. Those involved in implementing diversity programs—from committees and affinity groups to mentoring and training programs—must understand the risks associated with each of these activities. This seminar will provide participants with practical advice on how to advance the effectiveness of diversity programs while minimizing the risks.
