We Win Cases
We have successfully represented major companies around the world and obtained winning results in a wide variety of industries. A few of our most notable successes include:
- Obtaining a judgment in our client’s favor of $25.5 million after several years of hotly contested litigation in a contract and fraud dispute, arising from our client’s $2 billion purchase of a mortgage business.
- Winning a dismissal with prejudice of a complex putative class action brought against our client by a trustee and noteholders alleging breach of fiduciary duties, negligence, and deepening insolvency. Of the major advisors and accounting firms being sued, our client was the only firm to obtain dismissal.
- Obtaining a rare midtrial dismissal for our client in a $450 million suit in a district court, alleging usurpation/misappropriation of corporate opportunity, unjust enrichment, interference, and breaches of contract and fiduciary duty. Case listed on National Law Journal’s Defense Hot List for 2006.
- Obtaining summary judgment on behalf of a major software firm where plaintiff had sought damages between $500 million and $2 billion, in an action alleging breach of contract as a result of client’s failure to deliver certain software.
- Winning a victory in the Tenth Circuit where the claim exceeded $200 million, in a complex licensing dispute regarding the processing of credit card transactions.
- Securing a complete defense victory on summary judgment for our client, in an action seeking damages of $55 million for tortious interference, violation of state franchise law, and other claims arising from the sale of a major software firm. Third Circuit affirmed district court’s grant of summary judgment to all defendants.
- Successfully moving to dismiss all fraud and misrepresentation counts over a multimillion-dollar implementation and services contract for a major software firm.
- Securing victory in a one-week bench trial where we successfully avoided plaintiff’s claim for $4 million in damages in a sales tax case, for a major drugstore chain.
- Winning a defense verdict in a multimillion dollar claim for damages in a sales tax case for a major drugstore chain in a putative nationwide class action. Plaintiffs alleged that client engaged in deceptive, unfair, misleading, and otherwise unlawful conduct. Client will be filing a motion to dismiss the third action.
- Receiving a unanimous verdict from a Philadelphia Common Pleas Court jury in favor of a large real estate firm. Plaintiffs alleged that our client tortiously interfered with plaintiffs’ plans to build an outlet mall near a successful mall owned by client.
- Obtaining a groundbreaking decision in favor of defendants from the U.S. Court of Appeals for the Third Circuit in consolidated appeals in two cases where we represented a major healthcare firm regarding requirements for class certification under Federal Rule of Civil Procedure 23(c)(1)(B), the first decision by any federal court to construe this rule.
