Rebecca A. Falk is an associate in Morgan Lewis's Litigation Practice. Ms. Falk's practice focuses on complex commercial litigation across a range of industries, including some of Silicon Valley's largest technology companies. She also represents companies and individuals in all phases of criminal and regulatory investigations and prosecutions as well as parallel civil class action, derivative, and antitrust litigation. Ms. Falk also has experience with litigation counseling and avoidance, including counseling clients on electronic data and discovery issues.

Recent matters include:

• Represented a Fortune 500 corporation in its response to SEC and U.S. Attorney's Office inquiries regarding allegations of stock options backdating as well as parallel derivative and class action civil litigation.
   
• Represented an Asian technology company with respect to U.S. Attorney's Office inquiries regarding allegations of price fixing and parallel antitrust litigation.
   
• Represented a leading international pharmaceutical company in connection with an investigation into Medicare/Medicaid billing and Anti-Kickback Act issues. Representation resulted in the U.S. Attorney's Office and the Department of Health and Human Services declining to intervene in a pending qui tam action and dropping their investigation.
   
• Represented a Fortune 100 company in resolving a complex business dispute to avoid international litigation.
   
• Represented a leading Silicon Valley company in resolving commercial litigation involving complex breach of contract and intellectual property issues.
   
• Represented individuals employed by a Major League Baseball franchise in connection with the San Francisco U.S. Attorney's Office's investigation into steroid use and the related internal investigation conducted by the Commissioner of Baseball.

Ms. Falk received her J.D. from the University of California, Davis School of Law in 2003 and her B.A. in geology from Smith College in 1995.
