Richard S. Toder is a partner and co-chair of Morgan Lewis's Bankruptcy and Financial Restructuring Practice and is a former member of the firm's Compensation Committee and Advisory Board. Mr. Toder has represented institutional creditors, debtors, and committees in bankruptcy and restructuring cases throughout the nation and in crossborder situations for over forty years. Recent representations include Oneida, Ltd., where he represented JPMorgan Chase, as agent for lending syndicate; Iridium, where he represents JPMorgan, as agent for a syndicate of lenders owed $800 million; and Le-Nature’s, where he is counsel to Wachovia Bank, N.A., as agent for a lending group. He also represents the largest trade creditor in the Dana bankruptcy case. He has served as counsel for independent trustees in Chapter 11 cases and as a court-appointed Examiner.
Mr. Toder is a certified mediator in the Southern District of New York Bankruptcy Court and is often appointed by the Court and parties to serve in that capacity. In 1997, he was one of twelve attorneys listed by Turnarounds and Workouts as the "Top Bankruptcy Lawyers" in the country.
Mr. Toder is a director and a fellow of the American College of Bankruptcy and a conferee of the National Bankruptcy Conference. He previously served as an Assistant United States Attorney in the Southern District of New York. He has lectured extensively in all areas of bankruptcy for, among others, ABA, PLI, ALI-ABA, and the Bar Association of the City of New York and NYLJ Seminars.
