Joseph Brooks is of counsel in Morgan Lewis's Litigation Practice. Mr. Brooks focuses his practice on complex civil litigation at both the trial and appellate levels. He has substantial experience covering a broad range of commercial disputes, including product liability, toxic tort, antitrust, intellectual property, and securities law claims.
Mr. Brooks has been lead counsel in a number of substantial product liability cases involving commercial building systems, such as fire alarm, fire sprinkler, HVAC and deluge valve systems. He has litigated class actions involving a wide variety of claims, including toxic tort claims arising from exposure to lead paint, securities law claims, and product liability claims. Mr. Brooks has also litigated antitrust cases, including large class actions involving the shopping cart and industrial gas industries, monopolization and tying cases involving the building controls industry, and price-fixing and monopolization cases involving the healthcare industry. And he has been lead trial counsel in a number of multimillion-dollar jury and nonjury cases successfully tried in federal and state courts throughout the country.
On the appellate level, Mr. Brooks has prepared briefs on the merits in cases before numerous federal and state appeals courts and the United States Supreme Court, and he has argued before the United States Court of Appeals for the Third, Ninth, Federal, and District of Columbia Circuits; the Florida Third District Court of Appeals; and the Pennsylvania Superior Court. His appellate work has included an argument before the Federal Circuit for the successful appellant in a landmark international trade case that The International Lawyer described as "the most important case in 1998."
Mr. Brooks is admitted to practice in the District of Columbia and Massachusetts.
