Mitchell M. Blakely is an associate in Morgan Lewis's Intellectual Property and Litigation Practices. He practices in the area of intellectual property counseling and litigation. Mr. Blakely counsels clients on a wide range of intellectual property transactions, such as technology development agreements, patent licenses, software licenses, and service provider agreements. Mr. Blakely represents both plaintiffs and defendants in intellectual property disputes, including patent and trade secret litigations involving software, hardware, and semiconductor technologies.
Mr. Blakely also prosecuted patents in the electrical, mechanical, and software arts in the United States and abroad. For example, he has prosecuted patents related to analog and digital circuits, semiconductor manufacturing, web portals, micro-mechanical electrical systems, and consumer packaging.
Before practicing law, Mr. Blakely applied his electrical engineering education as a product developer of the Intel Pentium II (Deschutes) microprocessor, including device characterization, assembly and test development, and high-volume manufacturing.
Mr. Blakely's experience spans a wide range of technologies, including data protection software, remote monitoring software, antivirus software, computer architecture, semiconductor development and testing, analog and digital circuit design, voltage regulators, hard disk drives, MPEG, light emitting diodes, fluid dynamic and ball bearing motors, control systems, microwave communications, and optics.
Mr. Blakely is admitted to practice in California and before the U.S. Patent and Trademark Office.
Representative Cases
- Represented hard disk drive motor manufacturer in a patent infringement case related to fluid dynamic bearing motors, resulting in a successful settlement.
- Represented LED manufacturer at the International Trade Commission in a patent infringement case over light emitting diodes, resulting in the ITC issuing a limited exclusion order.
- Represented a third party in a patent infringement case related to discovery seeking information regarding a client’s screen capture technology. Successfully imposed a restrictive protective order governing access to client’s source code.
- Represented software company in state and federal court involving allegations of trade secret theft, unfair competition, and false advertising, related to customer relationship management software. Successfully defended a motion to compel production of hard drives.
- Represented software company in a patent infringement case over real-time data protection software, resulting in a successful settlement.
- Represented hard disk manufacturer against claims of patent infringement and trade secret misappropriation where the plaintiff alleged $800 million in damages.
