Robert J. Hudock is an associate in Morgan Lewis's Labor and Employment Practice. Mr. Hudock represents employers in administrative and civil litigation matters, from inception through trial, involving a wide variety of employment claims. He has defended several employers in lawsuits alleging wage and hour violations and currently defends employers against claims of wrongful termination, retaliation, discrimination, harassment, and family/medical leave law violations.

Mr. Hudock's employment litigation background is supplemented by his commercial litigation background, which he utilizes in defending employers against employment-related claims such as unfair competition, breach of contract, fraud, defamation, and trade secret violations.

Mr. Hudock has authored and argued significant trial court motions and briefs and has authored multiple appellate briefs, including all briefing in connection with a matter before the California Supreme Court.

Mr. Hudock received his J.D. from the University of San Diego School of Law in 2000, where he received the International Academy of Trial Lawyers Award for Outstanding Achievement in Trial Advocacy and Litigation Coursework, CALI Excellence Awards in Employment Litigation and Professional Responsibility, and the University of San Diego Alumni Association Scholarship. During law school, Mr. Hudock served as an extern for Judge Richard D. Huffman of the California Court of Appeal, Fourth District, Division One. Mr. Hudock received his B.A., cum laude, in psychology from the University of Connecticut in 1992, where he received the State of Connecticut Academic Scholarship.

Mr. Hudock is admitted to practice in California and before the U.S. District Courts for the Central and Southern Districts of California.

Selected Representations

  • Mr. Hudock successfully defended his property management company client in a complex case resolved through a three-week jury trial and subsequent bench trial phases in San Diego Superior Court. Plaintiffs' claims included multiple wage and hour violations, various California Labor Code violations, unfair competition, wrongful termination, fraud, breach of contract, breach of fiduciary duty, and fraudulent transfer of assets. Mr. Hudock obtained a complete defense verdict and also obtained both compensatory and punitive damages against plaintiffs on the employer's cross-complaint for defamation.
  • Mr. Hudock negotiated a very favorable, nominal settlement on behalf of a computer manufacturing and sales company in a case alleging disability discrimination, failure to accommodate, failure to engage in the interactive process, and CFRA family/medical leave violations. Plaintiffs' counsel solicited the settlement shortly after Mr. Hudock filed a motion for summary judgment on behalf of the client.
