Lauren B. Hoffer is an associate in Morgan Lewis's Litigation Practice. Ms. Hoffer focuses her practice on complex commercial litigation. She has handled cases in the substantive areas of contract disputes, trade secrets, insurance coverage, ERISA, antitrust, products liability, and labor and employment. She also has counseled clients on electronic discovery issues and document retention policies and represented clients in pro bono matters involving criminal law and political asylum.
Ms. Hoffer earned her J.D. from the Georgetown University Law Center in 2001, where she was a member of the Mock Trial Team that competed in the National Association of Criminal Defense Lawyers and the Tournament of Champions Mock Trial Competitions. She earned her B.A. from the University of Texas at Austin in 1998.
Ms. Hoffer is admitted to practice in Texas and the District of Columbia and before the U.S. District Court for the Southern District of Texas.
Selected Representations
- Represented insurance company against insurance broker's claims of breach of contract, RICO, and antitrust violations. Received summary judgment on behalf of client.
- Represented corporation in ERISA claim for long-term disability benefits, winning both summary judgment in the U.S. District Court for the Southern District of Texas and the Fifth Circuit appeal.
- Represented corporation before the U.S. District Court for the District of Minnesota in a breach of contract and trade secret misappropriation case. Achieved a $12 million verdict for the client, which the Eighth Circuit upheld.
- Represented global software corporation against competitor's claims of copyright infringement, computer fraud, breach of contract, and commitment of various torts. Managed global fact finding and electronic discovery in ongoing litigation.
- Represented global fresh fruits company in California products liability trial stemming from use of the DBCP pesticide in its Nicaraguan fields. Received favorable jury verdict for client.
- Represented insurance company in various insurance coverage cases pending in the U.S. District Court for the Southern District of Texas and Harris County District Court resulting in summary judgment on behalf of the company or favorable settlement of claims.
- Represented insurance company against consumer's claim of fraudulent sale of an annuity. Case resulted in favorable settlement for insurance company that came more quickly and for less money than all other codefendants.
- Represented energy trading company in a commercial arbitration resulting from a tolling agreement, which resulted in a favorable resolution for the client.
- Represented corporation in successful antitrust clearance for acquisition of a competing company. Represented litigation section on regulatory team in anticipation of litigation, but merger was cleared without the need for the courtroom or a second request from the DOJ.
- Created and implemented in-house discovery procedures for a Fortune 10 company to ensure consistent discovery responses.
