Patrick K.A. Elkins is an associate in Morgan Lewis’s Litigation Practice. Mr. Elkins focuses his practice on commercial litigation, products liability, and toxic torts. He represents clients in all aspects of civil litigation in both state and federal courts throughout Texas. Mr. Elkins also represents clients before the appellate courts of Texas and the Fifth Circuit Court of Appeals.

Mr. Elkins has represented a variety of individuals and corporations in complex commercial litigation, including cases involving contract disputes, partnership disputes, deceptive trade practices claims, and compensation coverage. He also has represented various corporations in product liability and premises defense work involving the energy and life sciences industries.

Prior to joining Morgan Lewis, Mr. Elkins practiced in the Houston office of Edwards, Burns & Krider LLP, which was recognized by the Houston Young Lawyers Association as the Outstanding Small Law Firm of 2004-2005.

Mr. Elkins received his J.D., magna cum laude, from the University of Houston Law Center in 2004, where he was managing editor for the Houston Law Review and named to the Order of Coif. While in law school, Mr. Elkins was awarded the inaugural Marvin D. Nathan Fellowship and, in conjunction with that fellowship, worked in the Southwest Regional Office of the Anti-Defamation League during the summer of 2003. He received his B.F.A. in theatre, with a specialization in design and production, from the University of Michigan in 2001.

Mr. Elkins is admitted to practice in Texas and before the U.S. Court of Appeals for the Fifth Circuit, the U.S. District Courts for the Southern, Northern, Eastern, and Western Districts of Texas, and the U.S. District Court for the District of Columbia. He is not certified by the Texas Board of Legal Specialization.

Selected Representations

  • Represented numerous corporations in the defense of asbestos and other toxic tort cases, including successfully arguing motions for summary judgment, attending depositions of plaintiffs, conducting motions practice, and drafting writ of mandamus.
  • Represented a major pharmaceutical company on discovery issues in connection with multidistrict litigation of mass products liability claims.
  • Obtained dismissal for lack of personal jurisdiction in a case involving alleged breach of contract in the purchase of equipment.
  • Obtained summary judgment for the owner of an energy generating plant in a case involving personal injury claims of a contractor's employee.
  • Represented an engineering company in a dispute with another engineering company over the alleged creation of a joint venture to provide services on a large construction project.
  • Obtained reversal of a summary judgment as lead appellate counsel in a case involving the Texas Human Rights Act, fraud, negligent misrepresentation, breach of contract, and unjust enrichment claims.
