Daniel Johnson is a partner in Morgan Lewis's Litigation Practice and a member of the Intellectual Property Practice Group Committee. He specializes in high-stakes complex litigation and has represented clients in cases venued in state and federal courts throughout the United States and before the International Trade Commission, the American Arbitration Association, and Judicial Arbitration and Mediation Services.

Some of his most recent cases include:

On July 18, 2005, after a three-week jury trial, Mr. Johnson, representing O2 Micro Technology, obtained a verdict in favor of O2 Micro for theft of trade secrets against Monolithic Power Systems (MPS). The jury found the theft was willful and the court enhanced the damages. The jury also found that O2 Micro did not infringe either of the patents asserted by MPS and invalidated both MPS patents and all asserted claims.

On November 22, 2006, Mr. Johnson was lead counsel on a patent infringement case that resulted in a jury verdict that ranked in the top 100 verdicts in the country. L.G.Philips LCD Co. v. Chunghwa Picture Tubes, U.S. Dist. Ct. for C.D. Cal. ($53.5 million).

On January 22, 2007, an ITC Administrative Law Judge recommended the issuance of an exclusion order involving LED technology in the matter of certain high brightness light emitting diodes and products containing same. Mr. Johnson acted as lead trial counsel on this matter.

Other significant cases include:

Mr. Johnson represented Compuware in a five-week jury trial venued in the Eastern District of Michigan against IBM. This dispute included claims of theft of trade secrets, antitrust claims, and claims for copyright and patent infringement. The case settled in Compuware’s favor on March 31, 2005 for $400 million.

Mr. Johnson served as a deputy attorney general to the state of California from 1973 to 1976. While a deputy attorney general, he represented Cal State Hayward and obtained a permanent injunction against the NCAA.

Mr. Johnson is recognized as an outstanding trial lawyer by numerous national and international associations and publications. He is co-author of the Rules of Civil Procedure in Patent Cases for the Northern District of California, has participated in numerous panels on trial advocacy, and has presented on the use of multimedia at trial on behalf of the American Bar Association. He has also been a presenter on panels on "Trial Advocacy," "Preparation of Expert Witnesses in IP Cases," and "Trial of a Patent Case."
