Benjamin Smith is a partner in Morgan Lewis's Litigation Practice. Mr. Smith's practice focuses on a range of state and federal complex commercial and civil litigation matters, with a particular emphasis on business tort, fraud, breach of contract, and unfair competition cases. Mr. Smith also has an extensive background in products liability litigation and consumer class actions, particularly in the pharmaceutical, medical device, and consumer products industries.
Mr. Smith focuses his practice on the representation of consumer products manufacturers, as well as high-technology corporations in the medical and computer networking industries. He has successfully resolved numerous large-scale lawsuits and class actions and has represented clients in all stages of litigation from discovery to appeal. In the past year, Mr. Smith obtained summary judgment in favor of a leading technology company in the Southern District of Florida and a midtrial defense verdict for the same client in Minnesota District Court. National Law Journal selected Mr. Smith and his team for its "Defense Hot List" in 2006 as a result of the defense verdict. Mr. Smith also successfully resolved several business disputes and personal injury actions on behalf of a major medical device manufacturer in the past year.
Mr. Smith received his J.D., cum laude, from Harvard Law School in 1998. He received his A.B. in human biology and political science from Stanford University in 1995, where he graduated with honors and Phi Beta Kappa. Prior to joining Morgan Lewis, Mr. Smith was an associate for Brobeck, Phleger & Harrison LLP in San Francisco.
