Sharon R. Smith is an associate in Morgan Lewis's Intellectual Property Practice. Ms. Smith focuses her practice on a variety of intellectual property counseling, enforcement, litigation and prosecution issues involving copyrights, trademarks, advertising, rights of publicity, domain names, trade secrets, SPAM regulation, privacy law, ecommerce and technology law, and unfair competition. Ms. Smith also advises clients on advertising, sweepstakes and other promotional programs.
Ms. Smith has a significant litigation background in state and federal court and in Trademark Trial and Appeal Board cases, including preliminary injunctions, discovery practice, writing briefs and motions, witness preparation, and trial preparation, trial and permanent injunctions. Recently, Ms. Smith was part of a trial team that successfully defended Publishers Clearing House against copyright infringement, trade dress infringement and false advertising claims. She was also part of a litigation team that successfully defended a defamation claim based on a defense under the Communications Decency Act.
Ms. Smith’s pro bono work includes trademark and copyright counseling and litigation, asylum representations, and landlord-tenant litigation and counseling. In one landlord tenant case, Ms. Smith was part of a trial team that obtained a trial verdict in favor of low-income tenants who were subject to illegal rental practices.
Ms. Smith worked as an extern to Judge Alex R. Munson of the U.S. District Court for the Northern Mariana Islands. Prior to attending law school, Ms. Smith worked as an analyst at the Judicial Council of California.
In 2002, Ms. Smith earned her J.D. from the University of California, Davis School of Law, where she was a senior executive editor of the UC Davis Law Review. She earned her B.A. from the University of California, Berkeley in 1997.
