Daniel C. Knauth is an associate in Morgan Lewis's Labor and Employment Practice. Mr. Knauth's practice focuses on representing and counseling employers in a wide variety of labor and employment matters arising under federal, state, and local law, including Title VII, ADEA, ADA, FLSA, and the FMLA.
Mr. Knauth regularly litigates single-plaintiff, multiple-plaintiff, and class and collective actions involving discrimination, harassment, retaliation, constructive discharge, wage and hour, and whistleblower claims before federal and state courts and administrative agencies, including the EEOC and New York State Division of Human Rights. Mr. Knauth's employment litigation background is supplemented by a general commercial litigation background, which he utilizes in defending employers in various breach of contract claims that often arise in connection with employment-related matters.
Mr. Knauth also negotiates and drafts employment contracts, offer letters, noncompetition provisions, and separation and settlement agreements; advises on personnel policies and employee handbooks; and counsels clients on a variety of federal and state employment laws. He has also conducted and defended numerous depositions and has conducted confidential workplace investigations.
Prior to practicing law, Mr. Knauth served on active duty with the U.S. Army and the New York Army National Guard. He earned his J.D., cum laude, from St. John's University School of Law in 1998, where he served as articles and notes editor for St. John's Law Review and was selected as "Best Advocate" in both the James F. Niehoff and Frank J. Rogers Trial Competitions. Mr. Knauth received his B.S. from Cornell University School of Industrial and Labor Relations in 1994.
Mr. Knauth is admitted to practice in New York and before the U.S. District Courts for the Southern and Eastern Districts of New York and the U.S. Court of Appeals for the Second Circuit.
