Our attorneys represent clients involved in all aspects of the wind energy industry, including wind energy development; debt and equity finance; and merger, acquisition and corporate activity. Their completed projects have totaled more than 3500 megawatts of capacity in the United States. Our attorneys have also closed wind project financing transactions representing both lenders and borrowers in excess of $3.5 billion.

Our wind project development experience includes significant work with engineering, procurement, and construction contracts; turbine purchase and sale agreements; warranty agreements; operations and maintenance agreements; power purchase agreements; interconnection agreements; land acquisition (including wind park easements, ground leases, rights over federal and state lands and transmission rights of way); local, state, and federal permitting and environmental compliance; and federal and state regulatory compliance. Morgan Lewis attorneys are also presently involved in several hundred megawatts of wind energy projects currently under development and construction in California, New Mexico, New York, and Texas.

Our experience includes the structuring of joint ventures and partnerships, corporate and project acquisitions and dispositions, and general strategic counseling. Our clients include wind power project developers, commercial and investment banks, utilities and other power purchasers, land owners, turbine manufacturers, service companies, corporate investors, and other entities involved in the wind industry, and we are presently advising clients on the purchase and sale of several wind energy projects.

Morgan Lewis attorneys have also assisted clients with the legal aspects of wind turbine technology development, manufacturing, and sales. Such work includes patent and other intellectual property issues, as well as contract negotiations related to turbine sales and installation. Recent transactions include the purchase and sale of more than 1000 MWs of wind turbine generators with major vendors, including GE, Vestas, Siemens, Mitsubishi, and Clipper.

Attorneys in the Wind Energy Practice regularly rely on the skills of our colleagues in the Real Estate, Energy Regulatory, Tax, Intellectual Property, and Litigation Practices. The firm also leverages its preeminent Federal Energy Regulatory Commission group to assist clients in the wind industry on both state and federal regulatory issues, and our attorneys have represented various utilities in their programs (RFPs) for the procurement of renewable energy. Our wind energy attorneys are active in the American Wind Energy Association and speak and lecture on various legal issues relating to wind energy development and finance.
