The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (the “Act”) has now become law. While the Act principally focuses on consumer and small business1 bankruptcy issues, it also includes significant changes to the Bankruptcy Code affecting large corporate Chapter 11 cases. With some exceptions, the Act generally has prospective application only – applying to cases commenced more than 180 days after its enactment.
This White Paper is an overview of the Act as it relates to large Chapter 11 cases.
