In twin holdings on June 26, 1998, the U.S. Supreme Court held that an employer may be liable for hostile environment sexual harassment caused by supervisors even when the employer did not know about the conduct. The Supreme Court also provided employers, for the first time, with guidance on establishing a valid defense to such a claim.
