California FEHC Proposes Draft Regulations to Clarify Sexual Harassment Training Law

Just as the January 1, 2006, deadline for compliance nears, the California Fair Employment and Housing Commission (FEHC) has issued draft regulations clarifying some of the thorny issues and key questions that have surrounded compliance with AB 1825, the state law mandating sexual harassment training for California supervisory employees. Released on December 16, 2005, the proposed regulations will be finalized—and potentially revised—after a 45 day public comment period.
First, the good news: Employers who have made a “substantial good faith effort” to comply with the law will not be required to retrain their employees if it turns out that the training did not comply with these regulations.
