The purpose of this White Paper is to help companies decide what policies they should adopt concerning access to, use, and disclosure of electronic and voice mail sent and received by their employees on company messaging systems. While varying significantly from company to company and jurisdiction to jurisdiction, the following issues should be considered:
- Employee privacy rights;
- The rights of third parties to obtain access to company records and the company's need to manage its resources;
- Copyright violations; and
- The unauthorized disclosure of confidential information.
