The ADAAA, signed into law on September 25, 2008 by President Bush, will make sweeping changes to the Americans with Disabilities Act (ADA). This legislation, enacted with broad bipartisan support, will significantly expand the scope of the ADA's coverage. Intended to overturn a series of U.S. Supreme Court decisions that interpreted the ADA narrowly, the ADAAA will make it much more difficult for employers to prevail against ADA claims. Thus, every employer covered by the ADA must take steps now to understand the new law.
