This LawFlash contains the link to the new “advance alert” letter that the OFCCP will soon use to notify companies of upcoming compliance reviews. Currently, the OFCCP does not give companies any advance warning that facilities will be selected for compliance reviews. A facility receives a scheduling letter and then has 30 days in which to submit its affirmative action plans and additional information identified in the Itemized Listing.

As announced at this year’s National Industry Liaison Group meetings, the OFCCP intends to notify companies in advance which of their facilities will be selected for compliance reviews over the course of the next 12 months. At some later point during the year, the OFCCP will send each selected facility the standard compliance review scheduling letter, which will begin the 30-day notice period for submission of desk audit materials.
