Computer Fraud and Abuse Act Awakens Media and Information Industries:
As corporate misappropriation and espionage cases continue to occupy the front pages of the mainstream press, courts have been issuing important opinions addressing how the civil claims provisions of the Computer Fraud and Abuse Act (CFAA), 18 U.S.C. § 1030, interact with other types of claims that may be more familiar to the media and information industries. The CFAA is developing into a critical weapon for companies seeking to protect their intellectual property.  Indeed, provisions of the CFAA that were once thought to apply primarily to cases where data was destroyed or information put at risk by an employee’s resignation are now being utilized by lawyers and courts in far more creative ways.
