The U.S. District Court for the Eastern District of Pennsylvania dismissed the consolidated derivative action against Morgan Lewis client NutriSystem, Inc., concluding that the complaint failed to prove that a presuit demand on the company's board would have been futile. This decision follows the August dismissal of the consolidated putative shareholder action.
