Donald J. Myers is a senior counsel in Morgan Lewis's Employee Benefits and Executive Compensation Practice. Mr. Myers focuses his practice on the fiduciary responsibility provisions of ERISA, and has experience counseling clients on related securities, banking, and insurance issues. He also works with financial institutions in structuring investments for pension plans. As a former government official, he is familiar with government practices and procedures and regularly represents clients before government agencies such as the Department of Labor, the Pension Benefit Guaranty Corporation, the Internal Revenue Service, and the Securities and Exchange Commission, as well as federal and state banking regulators.
Prior to entering private practice, Mr. Myers was Counsel for ERISA Regulation and Interpretation at the U.S. Department of Labor. Before that, he was Assistant Chief of the Office of Disclosure Policy at the Securities and Exchange Commission.
Mr. Myers has chaired various subcommittees of the American Bar Association and has been an adjunct professor at Georgetown University Law Center. He is a charter fellow of the American College of Employee Benefits Counsel and a board member of the BNA Pension and Benefits Advisory Board. He is listed in The Best Lawyers in America, named as a “super lawyer” for his employee benefits practice, noted in Legal 500 for his "deep experience and knowledge," and recognized in Chambers USA as one of America’s leading benefits lawyers. Chambers describes Mr. Myers as "a fiduciary guru" who is "highly regarded for his regulatory expertise and his imaginative, accessible and literate counsel."
Mr. Myers lectures and writes extensively on employee benefits issues. His writings include the book ERISA Class Exemptions, Fourth Edition; two chapters in ERISA Fiduciary Law, Second Edition; and a report on ERISA prohibited transactions for the BNA Compliance and Enforcement Library.
Mr. Myers earned his LL.M. in taxation from Georgetown University Law Center, his J.D. from Cornell Law School, and his B.A. from the College of the City of New York.
