Thomas F. Hurka is a partner in Morgan Lewis's Labor and Employment Practice. Mr. Hurka regularly counsels employers on and represents employers in litigation involving Title VII, the NLRA, the ADA, the ADEA, the FMLA, ERISA, WARN, the FLSA, USERRA, the FCRA, affirmative action programs, state and local employment laws, and state and local wage and hour laws. Mr. Hurka has experience representing employers in class action, collective action, and complex litigation, including lawsuits brought under Title VII, the ADEA, the FLSA, and ERISA.

Mr. Hurka also counsels employers on and represents employers in litigation involving restrictive covenants, unfair competition, misappropriation of trade secrets, breaches of fiduciary duty and duty of loyalty, fraud, and breaches of contract. Mr. Hurka’s trial experience includes representing employers in state and federal trials, arbitration, mediation, and state and federal administrative proceedings. He represents employers in collective bargaining, grievance adjustment, and matters before the National Labor Relations Board and appellate courts.

In addition, Mr. Hurka counsels employers on regulatory matters, union avoidance, workplace harassment and discrimination, personnel policies, wage and hour issues, employee handbooks and policies, executive contracts, severance agreements, independent contractor agreements, affirmative action, hiring, disciplining, and discharging. Mr. Hurka counsels U.S. and foreign-based companies on cross-border transactions and employment and outsourcing issues. He has represented multinational employers in global restructuring, reductions in force, policy changes, and outsourcing.

Mr. Hurka has represented employers in various industries, including retail, finance, automotive, pharmaceutical, airline, manufacturing, technology, insurance, accounting, and service, among others.

Prior to joining Morgan Lewis, Mr. Hurka was a labor partner at a leading international law firm.

Mr. Hurka has authored and co-authored numerous articles and other publications on various employment-related topics, as well as given speeches and presentations on these topics.

Mr. Hurka received his J.D. from the University of Pittsburgh School of Law, where he was a member of the National Order of the Barristers. He received his B.A. in economics and political science from the University of Rochester.

Mr. Hurka is admitted to practice in Illinois and Indiana.
