Thomas B. Kenworthy is a partner in Morgan Lewis's Litigation Practice. Mr. Kenworthy's practice focuses on patent litigation as well as complex commercial litigation. He represents clients in a variety of industries, including medical devices, telecommunications networking equipment, plastics, semiconductor fabrication equipment and computers.
Mr. Kenworthy is an experienced trial and appellate lawyer. He has tried eight patent infringement cases to verdict before juries, tried two patent-related cases to judgment, argued six patent cases before the U.S. Court of Appeals for the Federal Circuit, and been involved as counsel for petitioners and amici in connection with certiorari petitions in the U.S. Supreme Court involving issues of patent law and procedure. His appellate litigation experience includes appeals before the U.S. Courts of Appeals for the Third, Fourth, Fifth, Eighth, Ninth, Eleventh, Federal and District of Columbia Circuits, appellate courts of five states and the U.S. Supreme Court.
Mr. Kenworthy has served as lead trial counsel in civil cases litigated to judgment in the state courts of Pennsylvania, New Jersey, South Carolina, Texas and Washington, and in U.S. District Courts for the Eastern and Middle Districts of Pennsylvania; District of Delaware; Southern District of New York; Northern District of Illinois; District of Maryland; District of Columbia; Eastern District of Virginia; District of South Carolina; Southern, Middle and Northern Districts of Georgia; Southern District of Mississippi; and District of North Dakota.
Mr. Kenworthy is presently acting as the lead trial counsel on behalf of patentees and accused infringers in numerous patent infringement actions pending around the country. He is also the lead counsel in several patent appeals pending before the U.S. Court of Appeals for the Federal Circuit.
Prior to joining the firm, Mr. Kenworthy was a law clerk to Judge Benjamin R. Jones, Chief Justice of the Supreme Court of Pennsylvania from 1973-74 and served on active duty with the U.S. Marine Corps as a Judge Advocate from 1974-78.
Mr. Kenworthy is admitted to practice in Pennsylvania and before the U.S. Supreme Court.
