David M. Morris is of counsel in Morgan Lewis's Litigation Practice. Mr. Morris has extensive experience in complex litigation, including intellectual property, products liability, and general commercial matters. He has represented clients in a wide variety of industries including liquid crystal displays, human allografts, personal computers, medical devices, agricultural products, satellite transmission of entertainment programming, and distribution of petroleum products.
Mr. Morris is currently involved in a number of patent infringement litigations seeking to enforce patent rights relating to medical devices, personal computers, and cosmetics. He recently participated in a successful jury trial concerning human allograft technology, as well as a bench trial to resolve allegations of inequitable conduct. Prior to that Mr. Morris was involved in a jury trial relating to liquid crystal display technology that resulted in a significant jury award for the firm's client. He has participated in a significant litigation concerning infringement of patents covering various aspects of technology used in personal computers. Mr. Morris has also participated in a significant trial between leaders in the biotechnology industry regarding licensing and patent infringement issues in the field of genetically modified agricultural products.
Other technology-related litigation in which Mr. Morris has been involved includes matters related to infringement of patents covering coronary catheter products, disputed licensing rights, royalty payments pertaining to microprocessors used in computer printer technology, as well as software used by accounting firms. Mr. Morris has also successfully litigated a design patent for cellular telephones.
Mr. Morris's experience also includes participation in nationwide class-action litigation concerning franchise agreements; products liability cases concerning medical devices; and first and second chair trial and arbitration experience in state and federal courts in cases involving various tort liability theories, such as products liability and professional negligence.
Mr. Morris has appeared at trial or oral argument before the U.S. District Courts for the Eastern District of Virginia, the District of Columbia, the Northern District of Illinois, the Middle District of North Carolina, the District of Delaware, the Northern District of California, and the Central District of California; and before the Circuit Courts for the cities of Richmond, Norfolk, and Charlottesville, Virginia.
Mr. Morris is admitted to practice in the District of Columbia and Virginia and before the U.S. Supreme Court; the U.S. Courts of Appeals for the Federal Circuit, the District of Columbia Circuit, and the Fourth Circuit; and the U.S. District Courts for the Eastern District of Virginia and the District of Columbia.
