Donna Lee Yesner is a partner in Morgan Lewis's FDA Practice. Ms. Yesner focuses her practice on public healthcare and government contracts, with an emphasis on pharmaceutical and medical device public sector business.
Ms. Yesner has experience in the acquisition and reimbursement of federal healthcare supplies and services, particularly Department of Veterans Affairs, Department of Defense, and Department of Health and Human Services; compliance with laws and regulations governing the Medicaid, Medicare, Tricare, and the 340B drug discount programs, debarment and public policy affecting these programs; and healthcare fraud.
Ms. Yesner has experience in all aspects of federal procurement, and has particular experience in the areas of Federal Supply Schedule contracting, pharmaceutical research and development agreements, suspension and debarment and exclusion from federal programs, and national security issues. She regularly counsels companies regarding compliance with federal healthcare program requirements and the impact of these requirements on their business. In addition, Ms. Yesner has litigation and alternative dispute resolution experience before U.S. District Courts and Courts of Appeals, and before the U.S. Court of Federal Claims.
Ms. Yesner is a co-chair of the ABA Public Contracts Section Health Care Contracting Committee and is counsel to the Coalition for Government Procurement Health Care Committee. In 2006, she won a case in the U.S. Court of Appeals on behalf of the Coalition, saving the pharmaceutical industry more than a billion dollars in unlawful Tricare rebate claims.
Prior to joining Morgan Lewis, Ms. Yesner was a partner in the Washington, D.C. office of an international law firm.
Ms. Yesner earned her J.D. from Catholic University of America, Columbus School of Law in 1983 and her M.A. in art history from the University of Georgia in 1977. She earned her B.A. from the University of New Mexico in 1974.
Ms. Yesner is admitted to practice in the District of Columbia.
