Brendan Fee is an associate in Morgan Lewis's Antitrust Practice. Mr. Fee's practice focuses on civil antitrust litigation and counseling. He regularly litigates cases involving allegations of price-fixing, exclusive dealing, monopolization, group boycotts, price discrimination, and violations of state competition law. Mr. Fee also counsels clients on antitrust and dealer termination issues and has a background in appellate and class action litigation.
Recent representative matters include:
- Flying J, Inc. v. Comdata Network, Inc. (D. Utah) – Successfully defended Comdata against group boycott and monopolization claims brought by a rival credit card issuer.
- Willow Creek Fuels v. Buckeye Partners (E.D. Pa.) – Obtained dismissal at the pleadings stage of Section 1 and 2 Sherman Act claims, as well as Clayton Act Section 3 exclusive dealing claims brought against Buckeye by a terminated fuel distributor.
- Network Visual Services v. ARAMARK Sports and Entertainment (C.D. Cal.) – Obtained Rule 12 dismissal of Section 1 and 2 claims arising out of an alleged exclusive agreement to provide closed circuit advertising services at the Las Vegas Convention Center.
- POP Diesel Fuel Systems v. ASTM (D.N.M.) – Obtained denial of a motion for preliminary injunction and complete dismissal of Section 1 Sherman Act claim brought against a standard setting organization by a producer of triglyceride fuel.
Mr. Fee is a regular contributor to the ABA's Annual Review of Antitrust Law Developments and is active in the ABA's Section of Antitrust Law. He recently served as the Young Lawyer Representative to the Section of Antitrust Law's Unilateral Conduct Committee. In 2008, Pennsylvania Super Lawyers and Law & Politics magazine identified Mr. Fee as a "Rising Star" in the field of Antitrust Litigation.
Mr. Fee also is an adjunct professor at Rutgers University School of Law, Camden, where he teaches legal writing and analysis to first year law students.
Mr. Fee earned his J.D., with high honors, from Rutgers University School of Law in 2003. He earned his B.A. in literature and political science from Bloomsburg University of Pennsylvania in 2000, where he was a member of Sigma Tau Delta English Honor Society.
Mr. Fee is admitted to practice in Pennsylvania and New Jersey and before the U.S. District Courts for the Eastern and Middle Districts of Pennsylvania and the U.S. District Court for the District of New Jersey.
