Donald P. Sullivan is an associate in Morgan Lewis's Labor and Employment Practice, where he focuses on employee benefits and fiduciary liability litigation under ERISA.

Mr. Sullivan counsels and defends employers, insurance carriers, financial institutions, multiemployer pension and welfare plan trustees, and third-party administrators in ERISA and non-ERISA employee benefit and fiduciary breach class action and single-plaintiff lawsuits nationwide.  He also advises companies on plan administration and compliance with ERISA's fiduciary provisions, including the use of employer stock in retirement plans, allocation of plan expenses, investment of plan assets, and prohibited transaction exemptions.

Mr. Sullivan has a background in federal litigation, and has appeared in the courts of California, Colorado, Michigan, Montana, Nevada, New York, and Alabama. Since he began focusing on ERISA litigation in 2000, he has secured summary judgment or dismissal with prejudice numerous times on behalf of his clients. He also regularly represents the employer trustees of a large multiemployer pension plan in arbitration. Prior to joining Morgan Lewis, Mr. Sullivan clerked for Judge Everett A. Martin of the Fourth Judicial Circuit of Virginia.

Mr. Sullivan earned his J.D. from Georgetown University Law Center in 1996, where he was senior articles editor for the Georgetown Journal of Legal Ethics. Mr. Sullivan earned his A.B. from the University of California, Berkeley in 1993.

Mr. Sullivan is admitted to practice in California and before the U.S. District Court for the District of Colorado.
