Brett A. Snyder is of counsel in Morgan Lewis's Energy Practice. Mr. Snyder represents energy industry clients in connection with the regulation and restructuring of the U.S. natural gas and electric industries, including representation before the Federal Energy Regulatory Commission (FERC), the Commodity Futures Trading Commission (CFTC), the Department of Energy (DOE), the Federal Communications Commission (FCC), and federal courts. 

Mr. Snyder advises energy clients with respect to FERC regulation of the provision of interstate service as well as commercial matters, including the development of tariffs and operating statements, precedent and service agreements, other operating agreements, and non-conforming agreements.

Mr. Snyder advises clients with respect to new natural gas-pipeline and LNG-terminal projects under the Natural Gas Act, and assists clients through all stages of the certification proceedings before FERC.

Mr. Snyder also advises market participants regarding issues applicable to pipeline shippers, such as capacity release and standards of conduct issues, and federal regulation of natural gas industry. He is a co-author and co-editor of The AGA FERC Manual: A Guide for Local Distribution Companies, a comprehensive FERC manual for local distribution companies.

Mr. Snyder also represents electric utilities and power marketers before FERC. He has assisted electric utilities and power marketers with market-based rate applications and triennial reports, generation interconnection agreements, tariff amendments, merger applications, quarterly electric-transaction reporting, and interlocking directorate issues.

Mr. Snyder has represented clients in complex administrative litigation, including the California and Pacific Northwest refund proceedings surrounding the Western market disorders, as well as in appeals from agency decisions to the U.S. Courts of Appeals.  He represents clients in proceedings before FERC's Office of Enforcement, including public and non-public investigations, regulatory audits, and self-reporting.

Mr. Snyder advises industry participants regarding requirements under the Natural Gas Act and the Federal Power Act relating to the transfer of energy assets. He also represents energy and other companies in FCC licensing matters relating to mergers, acquisitions, and reorganizations, and has litigated pole-attachment disputes under the Pole Attachment Act.

Prior to joining Morgan Lewis, Mr. Snyder was a partner in the energy practice of an international law firm, resident in its Washington, D.C. office.

Mr. Snyder earned his J.D. from Georgetown University Law Center in 1998, where he was notes and comments editor for The Tax Lawyer and a John M. Olin Research Fellow in Law and Economics. He earned his B.S. from the Massachusetts Institute of Technology in 1992.

Mr. Snyder is admitted to practice in the District of Columbia and Maryland and before the U.S. Supreme Court and the U.S. Courts of Appeals for the Second, Ninth, and District of Columbia Circuits.
