James B. "J.B." Tarter is an associate in Morgan Lewis’s Litigation Practice. Mr. Tarter focuses his practice on dispositive motions before federal district courts and matters in front of federal courts of appeals.

Mr. Tarter represents individuals, political organizations, and corporations. Examples of his representations include:

  • Primary briefing associate and sat second chair for the oral argument in the U.S. Supreme Court for Global-Tech v. SEB (No. 10-6, decided May 31, 2011).  Successfully represented a U.S. patent holder in a case defining the proper standard of intent for inducement to infringe a patent under 35 U.S.C. § 271(b). The Court ruled for our client 8-1, upholding a $4.88 million jury verdict for inducing infringement of the patent.
  • Coordinating and supervising all briefing in a federal MDL proceeding for an oilfield services company. 
  • Representing a health care provider in an adversarial proceeding before the Department of Health and Human Services.
  • Drafting appellate briefs in state and federal courts, including the Texas Supreme Court and Texas Courts of Appeals.
Mr. Tarter also maintains a pro bono practice, where he currently assists in representing clients in a First Amendment case on appeal.

Prior to joining Morgan Lewis, Mr. Tarter served as a law clerk to Judge David B. Sentelle, Chief Judge of the U.S. Court of Appeals for the District of Columbia Circuit.

Mr. Tarter received his J.D. from Harvard Law School in 2009, where he received the Dean’s Award for Community Leadership, was a senior editor on the Harvard Journal of Law & Public Policy, and served as the Moot Court Chair of the Harvard Federalist Society. He received his M.A. in political science from Emory University in 2006. Mr. Tarter received his B.A., summa cum laude, in political science, history, and economics from Emory University in 2006 and his A.A. in history, with honors, from the College of Southern Idaho in 2002.

Mr. Tarter is admitted to practice in Texas and before the U.S. Courts of Appeals for the Second, Third, Fourth, Fifth, Sixth, Ninth, Eleventh, and District of Columbia Circuits, and the U.S. District Courts for the Northern, Eastern, Southern, and Western Districts of Texas.
