Thomas A. Linthorst is a partner in the Labor and Employment Practice. Mr. Linthorst represents employers in a broad array of labor and employment law matters.
Mr. Linthorst represents employers before state and federal trial and appellate courts and administrative agencies. Representative cases include class actions and claims for wrongful termination, sexual harassment, discrimination, wage and hour violations, and misappropriation of trade secrets.
- Employment Litigation: Represent employers before state and federal trial and appellate courts and administrative agencies. Significant experience with class actions and other complex litigation. Other experience includes claims for wrongful termination, sexual harassment, discrimination, failure to accommodate disability, denial of ERISA-covered benefits, wage and hour violations, and misappropriation of trade secrets.
- Counseling: Counsel employers of all sizes on full range of labor and employment law matters, including issues under Title VII, ADA, FMLA, ADEA, OWBPA, FLSA, WARN, ERISA, NLRA, and state law causes of action; advise employers on individual and group termination decisions, leaves of absence, accommodating disabilities, workplace privacy, and trade secret/non-compete/employee raiding issues; draft employee handbooks, employment agreements, severance agreements, and independent contractor agreements.
- Labor: Represent employers before the National Labor Relations Board, including unfair labor practice and representation proceedings. Significant experience in strike preparation and injunction proceedings, and ULP proceedings in connection with plant closure and subcontracting.
- Training: Conduct interactive sexual harassment prevention and diversity training for employees at all levels. Significant experience training employees in the pharmaceutical industry.
- Speaker/author: Speaker and/or author on leaves of absence, workplace privacy issues relating to e-mail and internet use, and trade secrets.
