Stephen E. Ruscus is a partner in Morgan Lewis's FDA Practice. Mr. Ruscus focuses his practice on federal drug pricing programs, government contracts, and litigation. His practice entails counseling, audits, and investigations in connection with government acquisition and reimbursements of federal healthcare supplies and services, with an emphasis on pharmaceuticals and medical devices. He has also litigated complex statutory and government contracts issues.
With respect to federal healthcare supplies and services, Mr. Ruscus has experience with Department of Veterans Affairs, Department of Defense, and Department of Health and Human Services procurement; compliance with laws and regulations governing the Medicaid, Medicare, and the 340B drug discount programs and public policy affecting these programs; and healthcare fraud.
In addition, Mr. Ruscus counsels clients on a variety of complex government contract law issues, federal procurement of commercial items and services (including under Federal Supply Schedule contracts), pharmaceutical research and development contracts, and resolution of government contracts disputes, as well as federal debarment and suspension. He has conducted investigations and prepared reports under the U.S. Department of Defense, the U.S. Department of State, and the U.S. Department of Veterans Affairs voluntary disclosure programs. Mr. Ruscus also has experience in litigation before the U.S. Court of Federal Claims, the U.S. Courts of Appeals, the Armed Services Board of Contract Appeals, and in bid protests before the U.S. General Accounting Office. Moreover, he holds a top secret security clearance.
Mr. Ruscus lectures on pharmaceutical procurement, reimbursement, and federal compliance issues. Prior to joining Morgan Lewis, Mr. Ruscus was a partner in the Washington, D.C. office of an international law firm.
Mr. Ruscus earned his J.D. from the Catholic University of America, Columbus School of Law in 1991 and his B.A. from the University of North Carolina in 1986.
Mr. Ruscus is admitted to practice in the District of Columbia and before the U.S. Court of Federal Claims.
