Paul D. Weller is a partner in Morgan Lewis's Litigation Practice. Mr. Weller's practice focuses on a wide range of commercial litigation. He has litigated claims ranging from breach of contract, fraud, and tortious interference with business relationships to product liability, insurance coverage, and securities violations. His representations in 2006 include a unanimous defense verdict on a $25 million tortious interference claim, as well as affirmance by the Third Circuit Court of Appeals of a district court decision granting both a summary judgment motion and a Daubert motion in favor of Mr. Weller's client. The Daubert decision by the district court is particularly noteworthy because the district court excluded not only the opposing party's liability expert but also its damages expert—a result that is notoriously difficult to accomplish.
Mr. Weller also has a background in a wide range of intellectual property and First Amendment litigation, including matters involving trademark infringement, false advertising, unfair competition, dilution, invasion of privacy, defamation, theft of trade secrets, copyright infringement, and patent infringement. He has litigated cases before state and federal courts at both the trial and appellate levels and conducted numerous evidentiary hearings. In that regard, Mr. Weller successfully defeated a motion for a preliminary injunction that threatened to enjoin a multimillion dollar product launch by one of Mr. Weller's clients in 2006.
Mr. Weller also regularly serves as a guest speaker on matters ranging from trial practice to diversity. In the fall of 2006, Mr. Weller chaired the Intellectual Property Owners Trade Secret Committee presentation at the IPO's annual meeting in Chicago, as well as a panel at the annual National Asian Pacific American Bar Association conference in Philadelphia that focused on the topic of diversity in the legal profession.
