David M. Kerr is an associate in Morgan Lewis's Litigation Practice. Mr. Kerr's practice is concentrated in the representation of companies and individuals in all aspects of complex civil litigation, focusing on international commercial arbitration. Mr. Kerr is currently representing several domestic nuclear utilities in connection with claims against the United States regarding obligations to accept and remove spent nuclear fuel.

Mr. Kerr's recent representations also include McKesson Corporation in an expropriation suit filed in the U.S. District Court for the District of Columbia against the Islamic Republic of Iran. The claims were based on a bilateral treaty, customary international law and Iranian law. Mr. Kerr has also represented Innophos Mexicana in an arbitration before the International Chamber of Commerce in Paris, France against the Moroccan Government's phosphate mining company, OCP.

In 2010, Mr. Kerr successfully completed the Fast Track to Member International Commercial Arbitration Training Program at the Chartered Institute of Arbitrators, North American Branch.

In 2006, Mr. Kerr attended the Third Annual Seminar on International Commercial Arbitration at the Washington College of Law. The four-day intensive seminar provided practical insight into handling Bi-lateral Investment Treaty (BIT) arbitration cases.

Mr. Kerr clerked for Judge Karen J. Williams of the U.S. Court of Appeals for the Fourth Circuit from August 2001 to August 2003.

In 2000, Mr. Kerr earned his J.D., high honors, from the George Washington University Law School, where he was an articles editor for The George Washington Law Review. He earned his M.A. from the Monterey Institute of International Studies in 1997 and his B.A. from the University of Notre Dame in 1994. 

Mr. Kerr is admitted to practice in the District of Columbia and New York.  He is a member of the Chartered Institute of Arbitrators and the International Law Section of the D.C. Bar.
