Michael F. Healy is senior counsel in Morgan Lewis's Litigation Practice. Mr. Healy's practice focuses on litigation involving the energy industry, including commercial contract, employment and environmental matters. He has litigated cases in federal and state courts, before federal and state administrative agencies, including the Nuclear Regulatory Commission, the Federal Energy Regulatory Commission, the Consumer Product Safety Commission, the Department of Labor, and the Kentucky Public Service Commission, and before arbitration tribunals.
Mr. Healy participated in an action in Texas state court on behalf of a Texas utility against contractors involved with the construction of the South Texas Nuclear Project. The action resulted in a settlement of $750 million paid by the contractor to the utility company and the other co-owners of the project.
Other significant nuclear litigation in which Mr. Healy has been involved includes representation of a New Jersey utility against a southeastern Pennsylvania utility in connection with claims arising out of the NRC-ordered shutdown of the Peach Bottom Atomic Generating Station. That case was settled through an alternative dispute resolution process for $131 million. He represented MidAmerican Energy Co., an Iowa utility, in an action against a Nebraska utility in connection with the shutdown of the Cooper Nuclear station. The case was settled for $15 million.
Mr. Healy represented Northeast Utilities and several of its operating companies in litigation and arbitration proceedings regarding the Millstone Nuclear Station. The plaintiffs sought approximately $300 million in damages. This matter was settled favorably after a 45-day arbitration hearing, with Northeast Utilities recording a pretax gain in excess of $150 million. Other arbitration proceedings in which he has been involved include a $220 million proceeding brought by the Government of Iran against a firm client, and representation of a national railroad company against equipment vendors.
Mr. Healy has also litigated antitrust and environmental issues in the district courts, including representation of the City of Norfolk, Virginia, and the State of Florida, and represented clients in disputes concerning take-or-pay clauses in contracts between natural gas pipelines and their customers.
With respect to appellate work, Mr. Healy has argued before the U.S. Supreme Court, the District of Columbia, Third and Fifth Circuit Courts of Appeals, the District of Columbia Court of Appeals and the Commonwealth Court of Pennsylvania.
Following law school, Mr. Healy served as law clerk to Judge Inzer B. Wyatt of the U.S. District Court for the Southern District of New York. In 1977, Mr. Healy became associated with Morgan Lewis and worked on a variety of litigation matters. In 1984, he became a shareholder at Newman & Holtzinger, which later became Newman, Bouknight & Edgar. He rejoined Morgan Lewis in 1994.
Mr. Healy is admitted to practice in the District of Columbia and before the U.S. Supreme Court and the U.S. Courts of Appeals for the District of Columbia, Third, Fourth, Fifth, Ninth and Tenth Circuits.
