Daniel E. Chefitz is a partner in Morgan Lewis's Litigation Practice. Mr. Chefitz concentrates his practice on policyholder insurance recovery counseling and litigation. He represents businesses in connection with environmental, asbestos, toxic tort, patent, trademark, product liability, and contractual disputes, with an emphasis on insurance coverage advice and litigation.

Mr. Chefitz represents policyholders in various types of insurance coverage disputes, including coverage for patent, copyright, and trademark claims; environmental damage claims; asbestos product liability claims; toxic torts; welding rod claims; advertising injury claims; and first-party claims. He also advises policyholders regarding shared insurance and captive insurance rights and obligations, and protects insureds' rights in bankruptcy proceedings and reorganizations, including rights associated with Section 524(g) injunctions. Mr. Chefitz is also experienced with the use and establishment of Qualified Settlement Funds under Section 468b of the Internal Revenue Code.

In environmental litigation, Mr. Chefitz has successfully defended and pursued numerous liability and cost recovery actions for clients in the automotive, railroad, and aerospace industries. Mr. Chefitz has also advised clients regarding the impact of various regulatory schemes promulgated under environmental statutes, including CERCLA, RCRA, and the Clean Air Act.

Mr. Chefitz is admitted to practice in the District of Columbia, Illinois, and Massachusetts and before the U.S. Court of Appeals for the District of Columbia Circuit, the U.S. District Court for the Northern District of Illinois, the U.S. District Court for the District of Columbia, and the U.S. District Court for the District of Maryland.

  • Represents former industry-leading automotive and railroad parts manufacturers in coverage litigations concerning asbestos, welding rods, environmental, and toxic tort liabilities.
  • Represents international apparel manufacturer in pursuing claims under an Ocean Marine Cargo Policy.
  • Successfully represented major objector to Federal Mogul reorganization plan, litigating novel issues under Section 524(g), and thereby preserving extensive non-debtor insurance assets.
